Terms of service
The Kennel Website Company is in a trial phase: we're currently testing demand, and the company's registration in the State of New York is in preparation. Until then, you can reach us at sufyan@honestdog.de; our mailing address and registration details will be added here as soon as they're final.
These terms of service govern the contract between The Kennel Website Company ("The Kennel Website Company," "we," "us") and breeders who sign up for a The Kennel Website Company subscription ("you").
The Kennel Website Company offers two plans, "Website" and "Website Plus," which differ in the features included. The price that applies is shown in the take-over form and on your invoice. All prices are in US dollars, and your invoice shows any sales tax that applies.
The preview is free. You pay only if you decide to keep your website and order it in the take-over form.
Ordering: when you click "Order with obligation to pay" in the take-over form, you make a binding offer. The contract is formed when we confirm your order by email.
Payment: we send your invoice by email, and you pay by bank transfer. We switch your website on once your payment arrives.
First term: your first term is 15 months, and we invoice 12 of them. It starts on the day we switch your website on. The price of the first term is due in advance with the invoice.
After the first term: your subscription continues until you or we cancel it. We invoice your plan's price twelve months at a time, in advance. It doesn't renew for another fixed term.
Canceling: you can cancel at any time with one month's notice to the end of a calendar month, but no earlier than the end of your first term. If your website hasn't been switched on yet, your cancellation takes effect with the same notice to the end of a month.
To cancel, use the "Cancel contract" button in your back office or email sufyan@honestdog.de. We'll confirm by email that we received your cancellation and tell you the date your subscription ends. Your website stays online until then.
If you've already paid for any time after your subscription ends, we refund that amount pro rata. Our refund policy explains when you can get a full refund.
We can cancel with the same notice, no earlier than the end of your first term. Either of us can end the contract right away for good cause, such as a material breach of these terms.
We don't exclude any warranty that applicable law gives you.
Governing law: these terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising from them will be decided by the state or federal courts located in New York County, New York, and you and we consent to their jurisdiction. If you're a consumer, nothing in these terms takes away a protection that the law of the state you live in gives you and that can't be waived by agreement.
Data processing terms
Once you take over your website, personal information about other people reaches you through it – above all applications from puppy buyers, entries on your waiting list, and contact details. You decide what happens to that information, and you're responsible for the privacy policy on your website. The Kennel Website Company processes it only on your behalf, as your service provider – and, where the GDPR or the UK GDPR applies to it, as your processor under Article 28. The following paragraphs are the data processing terms between you and The Kennel Website Company; they're part of these terms and apply from the take-over for as long as we process this information for you.
Scope: The Kennel Website Company stores this information, shows it to you in your back office, computes the fit score from the answers in an application, and sends the emails that go with it, such as confirmations to the people who write to you and notifications to you. It covers their contact details (name, email address and, where given, phone number and place of residence) and their answers and messages to you.
Instructions: The Kennel Website Company processes this information only on your documented instructions – these terms, your settings and actions in the back office, and your instructions by email – unless the law requires otherwise; in that case, we tell you beforehand where the law allows. We don't sell it or use it for our own purposes.
Confidentiality and security: everyone at The Kennel Website Company with access to this information is bound to confidentiality. We protect it with appropriate technical and organizational measures, in particular encrypted transport (TLS), encrypted storage of the database and files at Amazon Web Services, access only after sign-in and only to the data of one's own website, and daily automatic backups.
Subcontractors: you agree that we use Amazon Web Services (hosting, database and file storage in Frankfurt, Germany, including serving the web pages and images through Amazon CloudFront and email through Amazon Simple Email Service), and Google (the Gemini API, solely to read the public content of your previous website when the preview is built – Google receives none of the information that comes in through your website). We bind each of them by contract to equivalent data protection obligations. We'll tell you by email before we add or replace one; you may object within 30 days, and if we can't resolve your objection, you may cancel your subscription before the change.
Assistance and breaches: we help you answer requests from the people concerned and meet your own legal obligations, and we forward to you without delay any request that reaches us directly. If we become aware of a breach affecting this information, we notify you without undue delay and give you what you need for your own notices.
End of processing: when your subscription ends, we delete this information or, at your choice, hand it to you as a file and then delete the remaining copies, unless the law requires us to keep it. Copies in automatic backups disappear as those backups expire.
Information and audits: we give you the information you need to show that these terms are met and allow audits by you or an auditor you appoint who is bound to confidentiality. A written account with the relevant documents is usually enough; we'll arrange an on-site audit with you with reasonable notice.
